You agree to indemnify, defend, and hold harmless HIBM, its officers, directors, employees, volunteers, agents, and affiliates from any claims, liabilities, damages, or expenses arising out of your use, misuse, or distribution of Website content or violation of law.

WAIVER OF CLAIMS

10A. ARBITRATION & CLASS ACTION WAIVER

At HIBM’s sole discretion, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website may be resolved through binding arbitration administered in the State of Georgia, rather than in court.

You agree that: – Arbitration shall be conducted on an individual basis only – You waive any right to participate in a class action, class arbitration, or representative proceeding – Each party shall bear its own legal fees unless otherwise required by law

This clause does not prevent HIBM™ from seeking injunctive or equitable relief to protect its intellectual property rights.

If this arbitration provision is found unenforceable, the remainder of these Terms shall remain in full force and effect.

TRADEMARK NOTICE

The names, logos, slogans, and branding of Hope of Israel Baptist Mission™, including “Hope of Israel™,” “HIBM™,” “Hope of Israel Baptist Broadcast™,” “Touching the Apple of God’s Eye™,” and the Blue‑White Apple with Star of David®, are protected trademarks. Unauthorized use is prohibited.

SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

These Terms of Service and the Privacy Policy constitute the entire agreement between you and HIBM regarding use of the Website and supersede any prior or contemporaneous agreements, communications, or understandings.

13A. FORCE MAJEURE

HIBM shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, natural disasters, power or internet outages, labor disputes, pandemics, or failures of third-party service providers.

13B. HEADINGS FOR CONVENIENCE
